1. This agreement is being entered into for the purpose of personal use by the Renter and their family. Our policy requires the Renter must be able to prove that they are at least 25 years old upon check in, to permit use of the unit. The Rental is solely for occupancy for the rental period only. The Rental does not include any transportation of any type or any payment for charges incurred while occupying the unit. Under no circumstance may this timeshare unit be sublet, occupied or given to another party without the express consent of the Owner.
2. As is customary in the lodging industry, the Renter will need to provide the Resort a credit card imprint upon check-in as an incidental charges & damage deposit. The Renter is responsible for any issues in this area (other than normal wear and tear) to the unit or its contents that may arise during their stay, either payable directly to the Resort or secondarily to the Owner if subsequently billed for damages or missing inventory from the unit. Also, additional incidental charges, ie, telephone calls, meals, beverages, selected resort activities and sport rental, items of personal nature, faxes, internet hook up etc. for which the Resort may charge a nominal fee and incurred by the Renter is their responsibility. Additionally, LaCabana BRC charges the Renter the Aruba government's "Energy Tax" and their "House Keeping Fee" (approximately $15.00 US per day).
3. The Renter agrees to abide by all rules and regulations of the Resort during their stay and not to exceed the maximum occupancy for the unit. Failure to comply may result in eviction by the Resort. Should this occur, there will be no refund of rental fees to the Renter. Also, under no circumstance will the Renter permit pets of any kind nor allow smoking in the unit. Non-compliance could result in possible action to remedy any damages incurred, including but not limited to carpet cleaning and hypo-allergenic treatments.
4. Rent for the unit as listed above for the price and date period is to be paid to Charles & Mary Botsis (in US Dollars) via Credit Card or Paypal using the "Buy Now" Paypal link button below.
Upon payment, print 2 copies of this Rental Agreement adding your name, address, phone and email address, signing and dating. Then scan & email or mail one completed copy to the Owner, keeping one copy for your records. The Owner upon receipt of Rental Payment and a completed Rental Agreement will notify La Cabana BRC the Renter will be occupying the above Unit/Term and an official Confirmation Reservation (which the Renter must bring and present at check-in) for the unit/term will be emailed to the Renter.
There is a no refund once the timeshare is rented other than if this unit is uninhabitable as stated in section 5 of this rental agreement, and no other similar units are available for the same week at this resort. The parties have signed their names below to evidence their agreement to the terms and conditions of this rental agreement,
5. The Renter may use the Unit during the term of the agreement without interference subject to Resort rules and regulations and agreement terms for the term of this lease. If the Unit is not habitable on the day the term starts by reason of flood, fire, storm, or for any other reason as deemed by the Resort, the Owner shall refund the rent forthwith and will thereafter have no further liability to the Renter. Additionally, the Owner is not responsible for any inconveniences or interruption of services due to repairs, improvements, or for any other reasons beyond the Owner’s control.

6. All notices may be sent to the address or e-mail set forth at the end of this Rental Agreement.
